Under the  slogan of  “For a secure return of the displaced”

A fourth  awareness   seminar  was  held by Tammuz Organization for Social Development on Saturday 11/2/2017 within the Human Rights and Rule of Law Project for the Displaced Support  and Legal Clinic in Al-anbar Province at Buhairat Al-habbaniyah camp.
The seminar was attended by 34 displaced men and women, 15 women and 19 men , and was   attended also by the free legal clinic’s staff in Al-anbar province.  At the beginning our colleague Ali Ghwal  started by welcoming the attendants and giving a background  about the free legal clinic and its work in Al-anbar province as well as the goal of holding this awareness seminar . Then our fellow lawyer Abid Jazzaa Yasin presented his intervention about the mechanism and measures for the return of the displaced to the liberated areas explaining return registration process , marriage registration, birth and death registration , and notification measures in case of losing identification documents.  
 
- Return registration (Return verification means)
1- The displaced person who is willing to return has to consult the Ministry of Migration and Displacement branch in Al-anbar to record his/her willing to return. The mentioned branch will provide him/her with an identification letter to be presented to the competent authorities at the place of return, and his/ her displacement file will be closed. In this case, the branch at the place of return has to check his/her return by receiving the return confirmation letter from the local authorities at place of return . When confirmation measures are completed then the Ministry headquarters should be notified.
2- The displaced person  may consult the ministry branch at the place of return, and should submit a proof for his/her return (local authorities confirmations). The mentioned branch will inform the ministry and the branch, in which the displaced was registered, to close his/her file at that branch.     
3- One file to be opened for each family or individual to register the displacement, and all subsequent measures should be attached to the first file (the original), with no need to open further files.
4- Submitting the official documents, related to the closing of the file by competent authorities, and those documents which prove the return to the original living place or the usual place of residence ( mukhtar and local council confirmations sealed by the ministry branch at the place of return )
5- People who have not registered their displacement may register the displacement during   registration of their return, and submit, at the same time, the related documents of both the displacement and return to the return branch. The return branch has to inform the ministry immediately.
6-  Taking a legal commitment from the family, which returned from the displacement, confirming that it has not registered or received any return grant from any other branch.

 Moreover, the seminar addressed the mechanism for the registration of births, marriage contracts, deaths, and missing documents.

Births registration needs the following:
1- Birth document authenticated by the health office in the province
2- Authenticated marriage contract
3- Civil status identification cards of both parents
4- A seal of the National Security office to confirm his/her parents’ clearance of any  security indicator
5- Filling in a special form of the civil status office

How to register marriage contract:
1- Filing an application to the personal status court
2- Filing a case on the husband from the  personal status court
3- Submitting pertaining documents of the husband and wife
4- Submitting medical examination form
5- Two witnesses

How to register a death certificate:
1- Filing an application to the investigation court
2- Filing a case
3- Informing the police station to form  an investigation board
4- Attendance of two witnesses on the death

Measures taken to inform about missing identification documents:

1- Submitting an application to the court of investigation
2- Informing the police station
3- Issuance of a letter by the court to notify the offices concerned.

Then the floor was opened for the participants to ask their questions. Hameed M. Salih, a displaced, asked about the legal and administrative measures for him to obtain new documents instead of those captured by Daesh when controlled the city . The reply came from our fellow staff member Abid Jazaa Yasin that he should file a case in the court of investigation to conduct investigation then to inform the police station to form  an investigation board , after that a letter would be issued from the court of investigation to the parties  concerned, then identification documents should be issued by the civil status office. Another question from Ghufran K. Khalaf about her husband  who died during the shelling of Jazerat Al-khaldiyah in 2015 and that she couldn’t obtain death certificate for him ; how she could get it?. The question was answered by our colleague Abid Hazaa as follows:
1- An application to the court of investigation to conduct an investigation about the accident
2- Informing the police station to form an investigation board about the death
3- Attendance of two witnesses on the death accident
4- Issuance of a letter by the court to the forensic medicine
5- Issuance of a letter by the court to  the security authorities to confirm his/her clearance of any  security indicator

Moreover, our fellow lawyer Abid Jazaa clarified in his intervention the safety steps and carefulness that people should observe when they return to the liberated areas notably the risks of mines that were planted by the terrorist Daesh.
 
During this event 150 brochures were distributed to the participants who thanked the staff of the free legal clinc in Al-anbar province and TOSD  for their efforts and interest in the displaced affairs.
It is worth mentioning that the free legal clinic in Al-anbar is a project run by TOSD to provide free legal services for the displaced people of Al-anbar province in which a series of seminars are  being   held ; two seminars per month.
